The Sand Cay Condominium Association consists of a ten building complex situated directly on the Gulf of Mexico in Longboat Key, Florida. In the process of replacing an aging window, the Association discovered severe wood framing damage (hidden decay) around the unit. Concerned that the condition could be more widespread, additional testing commenced which revealed damage throughout all ten buildings. Facing the possibility of a large and complicated insurance claim, the Association retained the services of Charles R. Tutwiler and Associates, Inc. to assist in the assessment, preparation and presentation of their claim. After an extensive investigation by the insurance company, coverage was afforded and a payment representing their view of the loss was issued in the amount of $352,000.00. The irreconcilable differences in damages were resolved via the appraisal process for a final settlement figure of $3,315,000.00, or $2,953,000.00 over the insurance company's offer!
