Winter Storm Claims – Getting a Fair Settlement is Up to You

A recent article, Boston Area Expects a Flood of Claims After Record Winter points to the growing recognition that some property owners are in for a fight when it comes to obtaining a fair settlement for their winter storm damage insurance claim. As one homeowner from Plymouth, Mass. put it, “It’s a part time job just trying to navigate it all.” As you will read in the article, too many people “hope” they will get a fair offer from their insurance company. Our general advice is that while working with your insurance company, remember that this is your claim. So don’t rely on the insurance company alone to tell you how much they will pay. Make sure you get independent estimates from contractors to confirm what it will take to fix the damage.

Beware Roof Collapse, Ice Dams and Frozen Pipe Burst from Winter’s Deep-Freeze and a Tip from the Red Cross

Beware Roof Collapse, Ice Dams and Frozen Pipe Burst from Winter’s Deep-Freeze and a Tip from the Red Cross

With New England and now the eastern United States in a deep freeze from record snow and ice accumulation, remember the old saying, it’s the darkest before the dawn.  Yes, there will be a spring and it’s just around the corner according to the Old Farmers Almanac. Spring, also called the vernal equinox comes in the Northern Hemisphere on March 20th at 6:45pm to be exact. This shouldn’t minimize the extensive property damage being caused this winter as this excellent article on Ice Dams discusses. Many of our staff are gearing up to head north in order to help current clients and work with our public adjuster partners.

Public Adjuster Restores Order after Tierra Verde House Fire Turns into a Property Claim Nightmare

Public Adjuster Restores Order after Tierra Verde House Fire Turns into a Property Claim Nightmare
On February 28, 2013 a massive fire broke-out in this upscale waterfront home located in Tierra Verde, Florida burning off the roof and causing significant fire, water, and smoke damage to the rest of the building structure, custom furniture, and personal belongings.  As is typical with all fires, which become public record when the fire department gets called, the homeowner was “assaulted” (his words) by emergency service restoration contractors and public adjuster chasers who came from all over the State of Florida to give their sales pitch.  Unfortunately, this property owner fell victim and signed with a restoration company who provided an estimate with a “not to exceed” agreement. But when the contractor sent the invoice for services performed, it was triple the amount!  The insurance company was just as surprised and refused to pay an obviously exorbitant amount. The contractor’s response was to place a lien on the property until the situation could be resolved.

What you don’t know, you don’t know! Lessons learned from the 2015 Windstorm Insurance Network Conference
The 2016 Windstorm Insurance Conference at the Roosevelt Hotel in New Orleans was a huge success with 850 in attendance. The annual event is all about the best of the best in the property insurance industry that volunteer their time to teach and educate attendees on the latest trends. As a side benefit, the networking with leaders in their field is incalculable. Unlike many other forums around the country, this is the only one I am aware of where you encounter three or four faculty in a workshop all representing a different perspective.  Got questions, ask the panel--no issue or questions are off limits.

Policyholders must beware of roofers and contractors acting as insurance adjusters

A rising problem that we in the public adjusting profession have been dealing with for years seems to finally have caught the attention of Florida officials. That is, the practice of insurance adjusting without a license by roofers and restoration contractors who sometimes are also unlicensed. A recent article, Illegal for roofers to act as insurance adjusters, experts warn perfectly illustrates the growing problem that takes advantage of homeowners who are in a stressful situation trying to repair their property and get a fair settlement. Hats off to Nancy Dominquez of The Florida Association of Public Insurance Adjusters who states, “when you have individuals or companies trying to convince homeowners that their contracting or roofing license permits them to handle insurance claims, that's incorrect. Not only is it incorrect, it's against the law.”

Are October Hurricanes becoming the Norm? Hurricane Gonzalo Update & Business Interruption Insurance Primer

Most in the Caribbean Islands were unprepared.  In fact, one emergency operations manager downplayed the storm over the radio so much that thousands were caught off guard as they did not take the necessary precautions to protect their properties from Hurricane Gonzalo.  It is rumored he will soon lose his job.  At the request of some clients, I flew into St. Maarten the day after the storm passed.

Severe Flood and Wind Damage Claims Pose Equal Threat to Bigger Hurricane Events

Given the severe localized flooding to parts of Southern and the east coast of Florida this past week due to heavy rains, it’s timely to point out that it only takes one storm to trigger a property insurance claim that can decimate your property value. It’s interesting to note a recent article that reviews worldwide property loss stats. While we haven’t had a large catastrophe event it points out that a larger group of smaller storms can still impact insurance rates and property values. Smaller losses, as we have seen in our practice, can still create time consuming claim complications. The time to identify your “claims team” is before you suffer your loss. Work with your insurance agent to fully understand the claims process. Then identify trusted public adjusters, restoration contractors, and yes even property insurance attorneys so you don’t fall upon the predatory few that will try to make a buck from your loss.
